§ 2-232. Designated service area in which county is the sole and exclusive provider of sewer service.
(a)
The county identifies, establishes and certifies that the areas shown in one or more maps titled "Designated Service Area of Pickens County Public Service Commission:" and dated ____________ / ____________ / ____________ constitute areas that fall within the designated service areas in which the county is providing sewer service, has budgeted funds to begin providing sewer service, or applied for funds to provide sewer service as of the date listed thereon.
(b)
The public service commission may supplement the maps of designated service areas, if necessary, by written explanatory material identifying the boundaries of the areas.
(c)
The public service commission shall present proposed amendments or modifications of the maps of designated service areas to county council for approval and adoption by ordinance or resolution. Any amendments or modification of the maps shall become effective upon enactment of an ordinance or adoption of a resolution adopting such amendments or modifications.
(d)
After the adoption of maps establishing the county's designated service areas or the amendment or modification of such maps, no service contract entered into between another political subdivision or provider of sewer service and a residential, commercial or industrial customer within the county's designated service areas shall be valid and enforceable except where permission is granted, in writing, by county council. The public service commission shall have the right, upon approval by county council, to take legal action necessary to have a court of law declare such contracts illegal and unenforceable.
